Fiance Visa

If you are hoping to marry the love of your life, who happens to also be a foreign national, then petitioning for a fiance visa is route you would like to take.

Applying for a fiance visa, commonly referred to as a K-1 visa, allows for your fiance to enter the U.S. for the purpose of marriage. It does not allow for all benefits of other types of visas, for example for the fiance to work. However, once married, you may apply to further adjust the status of your spouse.

Petitioning for your future spouse's K-1 visa has its requirements. First, you, as the petitioner, must be a U.S. citizen; status as a permanent resident does not suffice. Second, you must have met your future spouse within the past two years. Third, you must intend to mary your future spouse within ninety days of your future spouse entering the U.S. Lastly, both you and your future spouse must be legally free to marry.

It should be noted that if you have applied for a K-1 visa multiple times in the past, you may be flagged by U.S. Citizenship and Immigration Services.
